Definitions

In this Fair-Trading Policy (referred to as “Terms”), the following definitions apply:

  • “You” refers to the customer.
  • “We” or “Us” refers to The Happy Bikers Ltd, operating as The Happy Bikers.
  • “Tour” refers to the tour selected from our website or brochure.
  • “Rental Supplier” refers to our rental partners.

Booking Agreement

By booking a Guided or Self-Guided tour that requires rental, you enter into a contract with the Rental Supplier. We are not liable for any equipment provided by the Rental Supplier.

COVID-19 Disclaimer

Bookings or amendments made after April 1, 2020, acknowledge the risks associated with COVID-19. We commit to ensuring a safe experience but accept no liability for uncertainties caused by the pandemic. Updates related to COVID-19 are marked as “COVID-19 UPDATE.”

General Terms for Guided and Self-Guided Tours

1.1 Booking Process

To confirm your booking, the following are required:

  • Completed reservation form
  • Full deposit payment

1.2 Conditions of Sale

Customer Responsibility: You are responsible for understanding these terms before purchasing a product.

Payments & Deposits:

  • Deposits are non-refundable and required for each participant.
  • Full balance payment is due 10 weeks before the tour’s start date.
  • Payments are in GBP (£), and you bear any bank fees.
  • Failure to pay results in tour cancellation and loss of funds.

Currency Fluctuations:

  • We absorb increases up to 2%; anything above that may require additional payment.
  • Travel vouchers can be used for tours only and are non-refundable.
  • Refund Credit Notes must be used before expiration; otherwise, a full refund will be issued within 28 days.

1.3 Cancellations

If You Cancel:

  • 70+ days before departure: Loss of deposit and 50% of additional payments.
  • 0-69 days before departure: Loss of deposit and 100% of additional payments.
  • No-show: Loss of deposit and 100% of additional payments.

Transfers & Alterations:

  • Transfers to another person or tour are allowed 70+ days before departure with a £30.00 admin fee.
  • Personal detail changes incur a £30.00 admin fee.
  • If we cancel due to extreme circumstances, you can transfer to another tour or receive a refund.
  • No refund for cancellations due to force majeure events (e.g., war, riots, natural disasters).

1.4 Delays

We are not responsible for unforeseen delays. You are responsible for additional costs like meals and accommodation. Routes and stops may change due to operational needs.

1.5 Disclosure

  • Criminal convictions and medical conditions must be disclosed on the booking form.
  • Non-disclosure may lead to contract termination and loss of payments.
  • Pre-existing medical conditions must be reported to ensure proper medical assistance.

1.6 Harassment Policy

  • We do not tolerate harassment of staff or representatives.
  • Harassment may lead to tour termination and loss of payments.
  • Criminal acts will be reported to the authorities.

2.0 Travel Details

Travel Arrangements: The Happy Bikers do not provide flights to tour locations. Only book your flights once your tour reservation is confirmed.

Passports, Visas, and Documentation: It is the customer’s responsibility to possess a valid passport or equivalent travel document for all countries visited or transited during the trip. If visas are required, you must secure them before departure. While The Happy Bikers can assist with documentation preparation, we are not liable for any issues or cancellations due to incorrect or missing documents.

Ferry Bookings: If your tour includes ferry travel, you must adhere to the ferry company’s Terms & Conditions. No refunds will be provided once fares are booked through The Happy Bikers. We are not responsible for travel disruptions or cancellations.

2.1 Driving and Bike Responsibilities

Riding Competency: Participants must be competent riders and follow local traffic laws and regulations. The Happy Bikers are not liable for accidents involving third parties, other participants, or solo incidents.

License Requirements: Riders must have a full and valid license for the motorcycle class they are operating. An International Driving Permit is recommended and can be obtained from major post offices.

Personal Motorcycle Use: Only insured, road-legal motorcycles with visible registration plates are permitted. The bike must be in good condition with a current MOT. Riders are responsible for their bike’s maintenance, compliance with local laws, and recovery or repair in case of a breakdown. Riders with pillions are responsible for their safety.

Insurance Requirements: Participants must have valid insurance for their motorcycle, themselves, and their pillion, including repatriation coverage. The Happy Bikers are not responsible for any incidents or accidents involving participants or their pillions.

Tour Awareness: By booking a tour, participants acknowledge they have reviewed the itinerary and daily mileage. It is the participant’s responsibility to assess their fitness and stamina for the tour. The Happy Bikers are not liable for any discomfort due to the tour’s difficulty.

3.0 Responsibilities of The Happy Bikers

Our Responsibilities:

  • We are accountable for any part of the program that we book and control, ensuring it meets the standards described in our brochure or promotional materials. We will provide comprehensive GPS data, detailed maps, and full hotel addresses. Tour guidance is at our discretion. If the guide becomes unavailable due to accident, illness, or other reasons, we will strive to provide a replacement. In exceptional cases where this is not possible, you agree to continue the tour using the provided notes, itinerary, and hotel bookings.

Limitations of Our Responsibility:

  • We are not responsible for amenities being out of service due to maintenance, weather conditions, or low demand.
  • We are not liable for personal injury, illness, death, losses, or liabilities resulting from third-party amenities, hotel facilities, or consumption of food, drink, or alcohol.
  • Hotel policies may require a government-issued photo ID and a credit card or cash deposit at check-in for incidental charges.

3.1 Returning from European Tours

In compliance with The Package Travel and Linked Travel Arrangements Regulations 2018, you will receive a return ticket or booking reference to ensure your return to the UK in the event of our insolvency.

3.2 Complaints Procedure

If you have a complaint during your tour, first contact our representative. If unresolved, write to us at The Happy Bikers, 8 Jekils Bank, Holbeach Saint Johns, Lincolnshire PE12 8RF. We will address your complaint within 28 days of receipt.

Assignment: We reserve the right to transfer, subcontract, or otherwise manage our rights and obligations under these terms. You may not do so without our written consent.

3.3 Legal Agreement

These terms, along with our privacy policy, form the complete agreement between you and The Happy Bikers, superseding prior agreements.

Debt Recovery: Unpaid debts will be referred to a debt recovery service, and you will be liable for recovery charges from the original action date.

Indemnity: You agree to indemnify us against losses, damages, costs, and expenses, including legal fees, arising from your breach of these terms.

Governing Law: These terms are governed by English Law, with disputes subject to the exclusive jurisdiction of the courts of England and Wales.

3.4 Our Liability

We can assist in arranging motorcycle rentals but are not liable for the actions or omissions of rental suppliers. We are not responsible for issues caused by:

  • Third parties unrelated to holiday services.
  • Unusual and unforeseeable circumstances beyond our control.
  • Events we could not foresee or prevent, such as war, civil unrest, industrial disputes, natural disasters, or extreme weather conditions.

Our liability is limited to the total price paid for the specific booking and excludes compensation for economic loss, loss of profit, or other indirect damages.
